Privacy Policy
Pink Octopus Pty Ltd (ABN 62 684 951 915), trading as Pink Octopus Labs (“we”, “our” or “us”), builds Paletteable, a colour-mixing companion app for oil painters. We are an Australian company and we take a deliberately minimal approach to data: almost everything happens on your own device or in your own private iCloud. This policy explains what we collect, why, and the choices you have. It is written to comply with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs), and addresses the rights of users in the EEA, UK and California.
Information we collect
Photos and camera
- Camera and photo library access. With your permission, Paletteable uses your camera or a photo you choose so you can pick a colour to match.
- On-device processing. Images are analysed locally on your device to extract colour. We do not upload, transmit or store your photos, and we never receive them.
Palettes, mixes and settings
- Stored on your device. The palettes you build, your colour matches and your app preferences are stored locally on your device.
- Optional private iCloud sync. If you enable iCloud, this data syncs across your Apple devices through Apple’s CloudKit using your own Apple ID. It is stored in your private iCloud database, encrypted by Apple in transit and at rest. We do not have access to your Apple ID or to your private iCloud data.
Feedback you send us
If you choose to send feedback from within the app — for example, to report a paint that looks wrong or to request a brand — we collect:
- the feedback you write (a title and message, and the type of feedback);
- basic technical details to help us reproduce and respond: your app version, operating system version and device model; and
- limited context about where the feedback came from in the app (such as the screen or palette in view).
This feedback is sent to us through Apple’s CloudKit and stored in our CloudKit database so we can read it, respond, and improve Paletteable. Please don’t include personal or sensitive information in feedback — we only need what’s relevant to the issue. Sending feedback is always your choice.
App content we provide to you
Paletteable downloads shared app content — such as the paint database and curated Master and Featured palettes — from our public CloudKit database. This is a one-way download to your device and does not involve sending us your personal information.
What we do not collect
- No analytics or tracking. Paletteable contains no third-party analytics, advertising or tracking software, and we do not build profiles of you.
- No accounts. There is no Paletteable login; iCloud uses your existing Apple ID.
- No location data and no access to contacts.
Community sharing
Sharing palettes to a public community is not part of the current release of Paletteable. If we introduce community sharing in future, it will be opt-in, we will update this policy first, and only content you explicitly choose to share would become visible to others.
How we use information
- To provide the app’s features — colour matching, mixing suggestions and palette management.
- To sync your palettes across your devices, if you enable iCloud.
- To read and respond to feedback you send, and to fix issues and improve the app.
Under the APPs and GDPR, our legal bases for the limited processing we do are the performance of our service to you and our legitimate interest in maintaining and improving the app. We do not use your information for advertising, and we do not sell or rent it.
Sharing and disclosure
- We do not sell, rent or trade your information.
- Apple. iCloud sync, feedback transport and storage, and app distribution rely on Apple’s services and are subject to Apple’s Privacy Policy.
- Legal reasons. We may disclose information if required by law or to protect our rights or users’ safety. We have no access to your photos or your private iCloud data to disclose.
Data storage and security
- Most of your data stays on your device.
- iCloud data is held in Apple’s infrastructure and encrypted by Apple.
- Feedback is stored in our CloudKit database, hosted by Apple.
- We operate no separate servers that store your personal data, and all network traffic uses HTTPS.
As Paletteable relies on Apple iCloud, your data may be processed on Apple infrastructure outside your country, including outside Australia. No method of storage or transmission is completely secure, but we keep what we hold to a minimum.
Your rights and choices
- Access and correct. You can view and edit your palettes at any time in the app.
- Delete. Delete palettes in the app, manage or turn off iCloud sync in iOS Settings, and remove all local data by uninstalling the app.
- Feedback. To access or delete feedback you’ve sent us, contact us at the address below.
Australia. Under the APPs you may request access to, or correction of, personal information we hold, and may complain to us or to the Office of the Australian Information Commissioner (oaic.gov.au).
EEA / UK (GDPR). You have rights to access, rectify, erase, restrict and object to processing, and to data portability. You may lodge a complaint with your local data protection authority.
California (CCPA). You have the right to know what we collect (described above) and to request deletion. We do not sell personal information.
Children’s privacy
Paletteable is suitable for general audiences and is not directed at children. We do not knowingly collect personal information from children. If you believe a child has sent us feedback containing personal information, contact us and we will remove it.
Changes to this policy
We may update this policy as the app evolves or for legal reasons. We will revise the date above and, for material changes, note them in the app.
