Privacy Policy

Pink Octopus Pty Ltd (ABN 62 684 951 915), trading as Pink Octopus Labs (“we”, “our” or “us”), builds Paletteable, a colour-mixing companion app for oil painters. We are an Australian company and we take a deliberately minimal approach to data: almost everything happens on your own device or in your own private iCloud. This policy explains what we collect, why, and the choices you have. It is written to comply with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs), and addresses the rights of users in the EEA, UK and California.

The short version. Your photos are analysed on your device and never uploaded. Your palettes stay on your device and, if you turn on iCloud, in your own private Apple iCloud. We don’t run analytics or trackers and we don’t sell your data. The only information that reaches us is feedback you choose to send from within the app.

If you choose to send feedback from within the app — for example, to report a paint that looks wrong or to request a brand — we collect:

This feedback is sent to us through Apple’s CloudKit and stored in our CloudKit database so we can read it, respond, and improve Paletteable. Please don’t include personal or sensitive information in feedback — we only need what’s relevant to the issue. Sending feedback is always your choice.

App content we provide to you

Paletteable downloads shared app content — such as the paint database and curated Master and Featured palettes — from our public CloudKit database. This is a one-way download to your device and does not involve sending us your personal information.

What we do not collect

Community sharing

Sharing palettes to a public community is not part of the current release of Paletteable. If we introduce community sharing in future, it will be opt-in, we will update this policy first, and only content you explicitly choose to share would become visible to others.

How we use information

Under the APPs and GDPR, our legal bases for the limited processing we do are the performance of our service to you and our legitimate interest in maintaining and improving the app. We do not use your information for advertising, and we do not sell or rent it.

Sharing and disclosure

Data storage and security

As Paletteable relies on Apple iCloud, your data may be processed on Apple infrastructure outside your country, including outside Australia. No method of storage or transmission is completely secure, but we keep what we hold to a minimum.

Your rights and choices

Australia. Under the APPs you may request access to, or correction of, personal information we hold, and may complain to us or to the Office of the Australian Information Commissioner (oaic.gov.au).

EEA / UK (GDPR). You have rights to access, rectify, erase, restrict and object to processing, and to data portability. You may lodge a complaint with your local data protection authority.

California (CCPA). You have the right to know what we collect (described above) and to request deletion. We do not sell personal information.

Children’s privacy

Paletteable is suitable for general audiences and is not directed at children. We do not knowingly collect personal information from children. If you believe a child has sent us feedback containing personal information, contact us and we will remove it.

Changes to this policy

We may update this policy as the app evolves or for legal reasons. We will revise the date above and, for material changes, note them in the app.
